This Agreement applies to all types of transactions between the consumer and the store. This Agreement shall become effective and enforceable once you accept it and begin the registration process with the store, pursuant to Article Ten of the Saudi Electronic Transactions Law.
The above introduction shall form an integral part of this Agreement. The following are the meanings and definitions of the key terms used throughout this Agreement:
1- (Store): This term includes all forms of the store available on the Internet, whether through an electronic application, a website, or a physical commercial establishment.
2- (Consumer): A person who engages in electronic commerce for the purpose of obtaining products or services provided by the store through its electronic platform.
3- (Agreement): This term refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.
1- The Consumer acknowledges that they possess the legal capacity recognized under Sharia and applicable laws and regulations to transact with the Store, or that they are at least eighteen (18) years of age.
2- The Consumer agrees that, in the event of violating this Article, they shall bear the consequences of such violation before third parties.
1- The Store's obligation toward consumers is to provide the requested service or product.
2- The Store may provide additional services, such as after-sales services or other related services, depending on the nature and type of the service or product requested by the Consumer.
1- The Consumer agrees to use the Store's electronic platform in a manner consistent with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
2- When purchasing a service or product from the Store, the Consumer agrees not to use such service or product in violation of public morals or the applicable laws and regulations of the Kingdom of Saudi Arabia.
Upon applying to become a member or user of the Store, you shall be required to provide certain information and select a username and confidential password to access the Store's services. By doing so, you agree to the following:
1- You are responsible for maintaining the confidentiality of your account information and password. You agree to immediately notify the Store of any unauthorized use of your account information or any other breach of your confidential information.
2- The Store shall not, under any circumstances, be liable for any direct or indirect, material or moral loss or damage that may result from the disclosure of the Consumer's username or password.
3- You agree to use your Store account or membership personally and acknowledge that you are fully responsible for it. If another person uses your account, this shall be considered evidence that you have authorized them to use the Store in your name and on your behalf.
4- You agree to use the Store with seriousness, integrity, and good faith.
5- You agree to provide true, accurate, current, complete, and lawful information about yourself as required during registration with the Store, and to update your information whenever it changes or whenever necessary.
6- Our Store undertakes to maintain the strict confidentiality of your personal information and contact details.
7- If the Store determines that you have provided false, inaccurate, outdated, incomplete, unlawful, or otherwise non-compliant information in violation of this Terms of Use Agreement, the Store shall have the right to suspend, freeze, or terminate your membership, store, or account on the platform, without prejudice to the Store's other rights and lawful means of recovering its rights and protecting other consumers.
8- In the event of failure to comply with any of the above provisions, the Store's management shall have the right to suspend or terminate your store or membership, or prevent you from accessing the Store's services again.
1- The parties to this Agreement agree that communication shall take place through the email address registered on the platform.
2- The Consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same legal effect as their written counterparts and shall constitute valid evidence for fulfilling applicable legal and Sharia requirements.
3- The Consumer agrees that the Store's management may communicate with and notify them of any provisions relating to this Agreement or their transactions by sending general messages to all Consumers or to specific Store users.
1- If any provision or clause of this Agreement is cancelled or becomes invalid or unenforceable, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, rules, and terms of this Agreement, which shall remain in effect until further notice from the Store's management.
2- This Agreement, which may be amended from time to time as necessary, constitutes the working mechanism, understanding, and agreement between the Consumer and the Store.
3- The Store may impose fees on certain Consumers depending on the offers, products, or services they request, or any fees or taxes imposed by the government on the relevant product or service.
4- The Store reserves the right to add, increase, reduce, or deduct any fees or expenses pursuant to the provisions and terms of this Terms of Use Agreement, regardless of the reason for the Consumer's registration.
1- The Store provides payment and settlement services through its partners. Payments may be made entirely online through the payment options available on the Store or through any other payment method provided by the Store from time to time.
2- The Store undertakes to determine the price of the service or product offered in its store in accordance with the prevailing market value.
3- The Store undertakes to provide invoices, payment receipts, and acknowledgment receipts for all amounts and revenues generated through its store, and shall provide the Consumer with an invoice for their purchase of any service or product.
4- The Store undertakes to maintain generally accepted accounting practices within its electronic store, in implementation of the provisions of this Agreement and in consideration of the legal, economic, commercial, and regulatory interests served by such practices.
1- All intellectual property rights relating to the Store are fully owned by the Store, whether such rights were owned prior to the establishment of this electronic platform or acquired thereafter.
2- The Consumer shall respect the Store's intellectual property rights, including the Store's name, words, logos, symbols, and other elements belonging to or displayed on the Store. All rights associated with the Store's name and identity are the Store's exclusive intellectual property rights.
1- The Store undertakes to conduct its commercial activities through this electronic platform in a lawful manner and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of this Agreement.
2- The Store shall not be liable for any claims arising from errors or negligence, whether such claims result directly, indirectly, incidentally, or from the Consumer or a third party, such as shipping companies.
3- (Store Name), its employees, owners, and representatives undertake to ensure that the product or service is safe, lawful, authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and used for lawful purposes.
The Store may suspend or terminate the Consumer's membership or restrict the Consumer's access to the platform's services at any time, without prior notice and for any reason, without limitation.
This Terms of Use Agreement shall be governed by and construed in accordance with the laws, regulations, and legislation applicable and in force in the Kingdom of Saudi Arabia. It shall be fully and exclusively subject to the regulations applicable by the competent authorities in the Kingdom of Saudi Arabia.
If any provision or clause of this Terms of Use Agreement is cancelled or becomes invalid or unenforceable, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, and terms of this Agreement, which shall remain in effect until further notice from the Store's management.
This Terms of Use Agreement, which may be amended from time to time as necessary, constitutes the terms of use, working mechanism, understanding, agreement, and contractual relationship between the Store and the Consumer. Both parties to this Agreement acknowledge and agree to the following:
1- Arabic shall be the governing language for the interpretation of the provisions of this Agreement or in the event of its translation into another language.
2- All prices displayed for the Store's services or products may be amended from time to time.
3- Any promotional or marketing offers provided by the Store are temporary offers. The Store reserves the right to modify or discontinue such promotional or marketing offers at any time.
4- The parties to this Agreement undertake to conduct their dealings with each other in a manner that does not violate Sharia principles or the applicable rules, laws, and regulations relevant to the nature of the relationship between the Store and the Consumer.
5- This Terms of Use Agreement may only be terminated pursuant to a decision issued by the Store's management.
